The Municipality identifies the poisoned animal pursuant to Article 94, 5, 17 of l. 3052/2010. If a poisoned animal is found in a grazing area, the Municipality is liable under Article 94,5,4 of Law 3852/2010 due to poor management of grazing areas. If the poisoned animal is a stray animal the Municipality has to collect it according Article 94, para. 2.28 of Law. 3052/10 and Article 9 par. 1 of Law. 4039/12. [Stray animals are picked up, driven in private or municipal pet shelters ( Article 9, par. 4 of Law. 4039/12]. The municipality is considered as the provisional holder of the poisoned animal under Article 5, par. 2 of l. 4039/2012. If the poisoned animal is dead, the Municipality is considered as the holder of toxic waste (a. 11 par. 6, n. 4042/12). The holder of toxic waste, the Municipality is liable for its management according Article 14, 37 n. 4042/12.
